1\u00b0 Carrier\u2019s liability & exclusions.<\/h2>\n\n

M\u00e9diterran\u00e9e Riviera Navigation (MRN) is a shipping company based in Monaco. As such, should the company be held liable, this would be exclusively in accordance with the terms and conditions of the legislation governing the carriage of passengers by sea (the Act of 18 June 1966, as amended by Act No. 86.1292 of 23 December 1986, and the implementing decree). MRN cannot be held liable for the following cases of force majeure: accident, breakdown, terrorist attack, war, bad weather, sabotage or any other damage rendering a vessel completely unavailable. These general terms and conditions of sale apply to individuals who have purchased their tickets via the ticket office, the company\u2019s website or from partner establishments. By purchasing a ticket, a passenger fully accepts these terms and conditions of sale to the exclusion of all other documents, such as leaflets or catalogues, which are for information purposes only. These terms and conditions of sale are available at all points of sale and on our website. MRN reserves the right to amend the terms of these conditions of sale at any time. The applicable provisions shall be those in force on the date of ticket sale. <\/p>\n

2\u00b0 Prices and promotions.<\/h2>\n

Fares cover the cost of transport. On-board refreshments are charged as extras. Cruise fares are fixed, inclusive of VAT, and clearly stated. They include the eco-tax for visiting national parks and protected sites, as well as various port charges. As fares, booking conditions and payment terms are set in advance, no changes or transactions will be negotiated on board or after the ship has departed. Weather conditions do not constitute grounds for a change in fares. Should a passenger be entitled to a discount, they must, upon request, provide appropriate proof. Promotional offers and discounts cannot be combined. Payment methods are: cash, bank cheques (only for amounts under \u20ac80.00) and credit card. <\/p>\n

3\u00b0 Use of the vessel.<\/h2>\n

Upon boarding one of MRN\u2019s vessels, passengers automatically submit to the authority of the captain. They must comply at all times with the instructions given by the crew and present their ticket upon boarding. Furthermore, passengers remain liable for any damage they cause on board. MRN accepts no liability for theft or damage to passengers\u2019 property and belongings (including in the event of sea spray). Children and minors under the age of 18 must be accompanied by an adult. <\/p>\n

With regard to the carriage of passengers with disabilities, the captain retains sole discretion and may refuse boarding to passengers with certain medical conditions, particularly depending on weather conditions or if there is a shortage of support staff. Women who are seven months or more pregnant are not permitted on board. They must inform the crew at the time of boarding. Under no circumstances shall MRN or its agents be held liable if a pregnant passenger fails to inform the crew. Appropriate attire is required. Courteous and appropriate behaviour is required on board the vessel towards other passengers, crew members and staff. Any breach of these obligations will result in the immediate disembarkation of the passenger and their accompanying persons at a port in accordance with the disciplinary and criminal regulations of the merchant navy. In this case, no refund can be claimed, and the return journey to the port of departure will be at the passenger\u2019s sole expense and under their full responsibility. Seating on board is unassigned, and a passenger cannot be refunded or receive a price reduction if the seat they wish to occupy is already taken. Dogs are our friends and are therefore welcome on board (except for the \u2018dolphin and cetacean watching\u2019 excursion), provided they do not pose a danger to other passengers or staff. The vessels are strictly non-smoking. Depending on changes to health regulations and the Vigipirate security plan, MRN may be required to adapt its cruise conditions and vessel access rules. <\/p>\n

4\u00b0 Cancellations, delays & refunds.<\/h2>\n

Tickets are non-transferable and may not be resold. They are neither exchangeable nor refundable and are valid for a specific departure on a specific date from a specific port. In the case of a ticket for a stopover on an island, the journey is a return trip (returning on the same day). MRN reserves the right to choose the vessel used for its cruises. Therefore, a ticket purchased corresponds to a destination but in no way to a specific vessel. <\/p>\n

–Cancellation by the carrier:<\/strong> MRN and its representatives retain sole discretion in assessing weather conditions. MRN reserves the right to cancel or alter departures for reasons of passenger safety and comfort. In this case, and in this case only, MRN undertakes to refund tickets or to reschedule them for a date chosen by the passenger (subject to availability on board and for the current season). The passenger shall not be entitled to any other form of compensation, regardless of the loss incurred. In the event that tickets have been purchased from a partner establishment (such as a hotel, tourist office or similar), the refund must be processed by said establishment. <\/p>\n

-Cancellation by the passenger:<\/strong> Tickets are non-exchangeable and non-refundable, regardless of where they were purchased.<\/p>\n

-Passenger delays:<\/strong> Boarding must be completed no later than 15 minutes before departure. If a passenger is not on board at the time of departure, they are not entitled to any refund or compensation. <\/p>\n

-Delay of one of the vessels:<\/strong> We would like to remind you that return times are indicative and may be changed without notice by MRN; in such cases, no adjustment to fares will be made. Passengers shall not be entitled to any compensation whatsoever, regardless of the nature of the loss or damage suffered. Upon disembarkation on the islands, the captain will announce the return times over the PA system. These times will be adhered to, and the vessel will leave the quay at the appointed time (as recorded in the logbook). If a passenger misses the vessel\u2019s departure, the return to the port of departure will be at their own expense and under their sole responsibility, and no refund will be granted. <\/p>\n

-Special cases: <\/strong>On the \u2018Dolphin and Cetacean Discovery\u2019 cruise, if no animals are sighted, a \u2018Monaco by Sea\u2019 tour is offered as a gesture of goodwill. One ticket purchased entitles the holder to a free place on a morning tour or on a date proposed by MRN. However, no refund will be issued if a passenger does not take up this offer. <\/p>\n

-Refund method:<\/strong> Depending on the payment method and technical constraints, MRN will issue refunds via credit card or bank transfer. Cash refunds are not permitted. <\/p>\n

5\u00b0 Online purchase.<\/h2>\n

Tickets can be purchased directly on the MRN website. Passengers do not need to print these tickets if they can show proof of purchase on their smartphone. However, if a passenger is eligible for a promotion or a reduced fare, they must purchase their ticket at the ticket office in the Port of Monaco. <\/p>\n

6\u00b0 On-board CCTV.<\/h2>\n

MRN vessels are under video surveillance to better ensure your safety whilst at sea and in port. In accordance with the legislation in force: Law No. 95-73 of 21 January 1995, Decree No. 96-926 of 17 October 1996. If you have any questions regarding access to the CCTV system, please contact the ship\u2019s captain. <\/p>\n

7\u00b0 insurance.<\/h2>\n

MRN has taken out professional liability insurance, and all its vessels are insured (hull and P&I) against any damage that may be caused to a third party.<\/p>\n

8\u00b0 Management of personal data.<\/h2>\n

In France, personal data is protected in particular by Law No. 78-87 of 6 January 1978, Law No. 2004-801 of 6 August 2004, Article L. 226-13 of the Criminal Code and the European Directive of 24 October 1995. When using the riviera-navigation.com website, the following may be collected: the URL of the links through which the user accessed the site, the user\u2019s internet service provider, and the user\u2019s Internet Protocol (IP) address. In any event, MRN only collects personal information relating to the user for the purposes of certain services offered by the riviera-navigation.com website. The user provides this information in full knowledge of the facts, particularly when entering it themselves. In accordance with the provisions of Articles 38 et seq. of Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties, all users have the right to access, rectify and object to the processing of their personal data by submitting a written and signed request, accompanied by a copy of their identity document bearing the holder\u2019s signature, specifying the address to which the reply should be sent. No personal information relating to the website user is published without the user\u2019s knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. The website is not registered with the CNIL as it does not collect personal information. The databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96\/9 of 11 March 1996 on the legal protection of databases. <\/p>\n

9\u00b0 Swimming break.<\/h2>\n

Swimming in the sea is restricted to people aged 10 or over who are in good health and can swim confidently. The area is unsupervised (no lifeguard on duty) and swimmers are entirely responsible for their own safety. The captain may cancel all or part of the swimming stop without prior notice. In the event of the swimming stop being cancelled, no refund or discount will be given. <\/p>\n

10\u00b0 Notifications & disputes.<\/h2>\n

Any claim must be sent by registered post with acknowledgement of receipt as soon as possible, and no later than one month following the date of the service, accompanied by supporting documents, to the company whose contact details are given in the footer. In the event of a dispute, the parties agree to attempt to reach an amicable settlement within one month of the dispute arising.
